Slip and Fall: A Case

As you are walking down the grocery aisle of an unnamed convenience store, unmindful of everything else around you as the world turns, you pick up various canned goods that will keep you living for a week or so. Your favorite canned soup is off the highest shelf, and for lack of better judgment, you reach out to it with the tip of your finger. You lose focus. Your feet slips. The cans come crashing down. Your world turns black.

While this may all look like a big hoopla to some people, more and more people are experiencing this type of situation. Sometimes you are left to wonder whether you should have skipped on the heels, or if you shouldn’t have ignored the “Wet Floor” sign. But things have happened, and there’s nothing to do about it. The big question now is “Who is responsible?”

One would always hear a lot of drama about people slipping down and then sending a lawsuit complaint at the owner for not taking responsibility of the place. Most of the time, complaints like these are dismissed, with only a small majority that is won, with little compensation though. Ask yourself first whether it is worth the bother of doing so.

If your injury was caused by a foreign object that is needed in that spot, like a rubber mat for example, and tripped on it, then it wouldn’t be the owner’s fault since that mat has a purpose in there and is probably serving a purpose on its own. This type of injury is easily seen as a result of clumsiness, and is often, in most cases, dismissed.

But a different case is when for example, you slipped on the floor because it was wet. There was no notice sign that the floor was wet. Probably because a spill happened and it wasn’t cleaned. Or maybe an employee mopped the area but didn’t put a sign telling customers about it. This is a clear sign of negligence and can be used as a case against the owner.
